Me: Who would have been eligible to comment and how would they have known that this was their chance to do it?

 

Barry: Any one in the public. All the employer representatives had all these proposals and they were put out on the web site and they were mailed out to people in the normal way that this stuff gets done. So the day that it was to be voted on, a couple of the employer representatives showed up and belatedly said, "gee whiz, we never noticed this, we don't like this, we missed it."

I said that all I was trying to do is, there should be no right without a remedy and that all we're doing is putting a penalty in there.

The employers apparently missed the issue altogether, and it just got voted on right there, by a 3 to 2 vote , and that's how it happened. The assumption, I think, that a lot of people made, was that people were getting their meals and rest breaks to a much greater degree than, in fact, was the case.
